In this paper we examine a puzzle recently posed by Aaron Preston for the traditional realist assay of property (quality) instances. Consider Socrates (a red round spot) and red1—Socrates’ redness. For the traditional realist, both of these entities are concrete particulars. Further, both involve redness being `tied to’ the same bare individuator. But then it appears that red1 is duplicated in its ‘thicker’ particular (Socrates), so that it can’t be predicated of Socrates without redundancy. According to Preston, this suggests that (...) a concrete particular and its property instances aren’t genuinely related. We argue that Preston’s proffered solution here—to treat property instances as “mental constructs”—is fraught with difficulty. We then go on to show how, by fine-tuning the nature of bare particulars, treating them as abstract modes of things rather than concrete particulars, the traditional realist can neatly evade Preston’s puzzle. A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. According to the nineteenth century English philosopher John Stuart Mill, all human beings desire to live lives pregnant with happiness; we all long to be the recipients of liberal amounts of varied, high quality pleasures with pain making as brief an appearance in our conscious experience as possible. Happiness is the one and only thing we desire for its own sake; everything else is desirable simply as a means to securing happiness. Perhaps this is so. Mill, however, went on to (...) argue that promoting happiness of this sort is not only desirable, it is in fact a moral obligation on our part. Suppose that on some delicious fall evening you are contemplating whether to pick up Dickens' David Copperfield and read a chapter or two. Well, given the alternatives before you, if reading Dickens would result in the greatest amount of happiness, not only for yourself but also for all those affected by your solitary, bookish reverie, then you can be sure your action is morally right and indeed obligatory. Clouser and Gert’s 'A Critique of Principlism’ (1990) has ignited debate over the adequacy of substituting principlism for moral theory as a means for dealing with biomedical dilemmas. Clouser and Gert argue that this sort of substitution is not adequate to the task. I examine their argument in light of recent defences of principlism on this score, those of B. Andrew Lustig (1992), David Degrazia (1992), and Beauchamp and Childress (1994). I argue that both sides in the debate have (...) assumed differing conceptions of a moral theory that virtually guarantee their respective conclusions. These differing conceptions are motivated by antecedent epistemological commitments. The present debate over principlism is therefore inconclusive. Future discussion should focus on the underlying epistemological issues. (shrink)

According to David Lewis, we all believe there are countless ways in which things might have been different from the way they are in fact. Surely, for example, the world could have existed even if, say, Quine had been a politician, or if there had been one less page in Word and Object, or indeed if there had been no such person as Quine at all. All these things, we are inclined to think, might have been the case. And (...) thus we find ourselves saying, “There are many ways things could have been.” However, as Lewis notes, this sentence involves an existential quantification over objects of a peculiar sort: “ways things could have been”—”possible worlds,” if you like. At face value, then, our modal discourse commits us to belief in possible worlds—as peculiar as that may seem. Those who feel squeamish at this prospect can perhaps console themselves with the fact that failure to believe in real, live alternate possibilities ends in Spinozism: the view that (in Samuel Clarke’s words) “nothing which is not, could possibly have been; and nothing which is, could possibly not have been; and that no mode or circumstance of the existence of anything could possibly have been in any respect otherwise than it now actually is.” For most of us, I dare say, this is a difficult pill to swallow. This subject inevitably leads to discussion of other issues. Is art distinct from life? Is a concern with art's messages consistent with an appropriately aesthetic appreciation of its works? Is there anything distinctive about the manner in which art communicates its messages, or about the messages it conveys? The topic of art's social (...) and moral importance has always been a central one in aesthetics. However, whereas Plato and Schiller, for instance, viewed art as intimately implicated in a person's moral and social education, modernist theories have argued for art's autonomy and separation from worldly matters. Some twenty years ago, when I submitted a dissertation proposal to explore connections between theologies of creation and views of scientific (...) knowledge in the seventeenth century, my doctoral committee was not initially enthusiastic—my idea might make a good dissertation in religion, but was it really history of science? I doubt I would have a similar experience today. Not only has the "warfare" thesis of science and religion been laid permanently to rest, historians have begun seriously to question whether it makes sense even to treat "religion" and "science" in an essentialist manner as separate ways of thinking that do not ordinarily interact. Many detailed case studies demonstrating a variety of fascinating, often important connections between science and religion have appeared from leading scholars in the past two decades. This trend continues in the latest volume of Osiris, which contains sixteen essays documenting various ways in which religious beliefs have influenced the actual content and presentation of science.The volume opens with two companion essays laying out the terrain. First, Brooke engages the new methodological and conceptual problems that confront historians following the demise of the "warfare" thesis. Then Stephen Wykstra offers criteria for sorting out the various roles for metaphysical and religious beliefs (which he distinguishes) in shaping scientific knowledge. The case studies begin with E. Jamil Ragep's essay on medieval Islamic astronomy, arguing that religion sometimes had a constructive role—a rather novel claim for Islamic science, he points out. Noah J. Efron and Menachem Fisch show how early modern Jewish exegetical practices influenced David b. Solomon Gans's interpretations of astronomical texts, and quite possibly his interpretation of nature also. A Christian astronomer is next, as Peter Barker and Bernard R. Goldstein detail how Johannes Kepler's theology contributed directly to the discovery of scientific laws. Maurice A. Finnocchiaro then reviews various accounts of the Galileo affair, finding far more conflict in the subsequent historiography of the events than in the trial itself.Moving from astronomy to natural philosophy, Margaret G. Cook's essay on Robert Boyle examines the web of connections between theology, the mechanical philosophy, and [End Page 277] "the Aristotelian philosophy that he sought to replace." She demonstrates that Boyle used the classical art/nature distinction "to interpret the biblical account of the Creation and to argue that chemical techniques offered experimental confirmation that the world, created by art, worked by the same mechanical principles as artificial objects, not by the inherent agency of Aristotelian nature" (136). Margaret J. Osler also writes about Boyle. Contrary to the traditional view that final causes were expunged from science by the mechanical philosophy—a view that originated in the "positivism and scientific optimism" of the postwar period (168)—she proves that final causality remained central to the thought of Boyle and Pierre Gassendi. The essay by Stephen D. Snobelen presents substantial evidence that the famous General Scholium, appended to the second edition of Isaac Newton's Principia, was a carefully worded declaration of Newton's heterodox theology. "A Trinitarian," Snobelen concludes, "could not have written the General Scholium" (186). He also shows the degree to which Newton's theology shaped his overall natural philosophy, decisively debunking the late Richard S. Westfall's view that such influences could not be found.The final seven essays are mainly devoted to nineteenth-century science. Michael J. Crowe documents several ways in which Christian beliefs about divine goodness and the Incarnation affected astronomy. Martin Fichman shows how Alfred Russel Wallace's theism—not merely a vague spiritualism, as traditional accounts claim—"shaped the cognitive content of his mature evolutionary synthesis, which included a theoretical reconceptualization of the scope of natural selection" (227). One of Chicago's great cultural achievements, the Institute of Design was among the most important schools of photography in twentieth-century America. It began as an outpost of experimental Bauhaus education and was home to an astonishing group of influential teachers and students, including Lázló Moholy-Nagy, Harry Callahan, and Aaron Siskind. To date, however, the ID's enormous contributions to the art and practice of photography have gone largely unexplored. Taken by Design is the first publication to examine thoroughly this remarkable institution (...) and its lasting impact. With nearly 300 illustrations, including many never-before published photographs, Taken by Design examines the changing nature of photography over this critical period in America's midcentury. HUME AND COLLINS ON MIRACLES Some portions of 18th century intellectual history seem like puzzles of which the most important pieces are missing. In some lucky instances the pieces have not been lost altogether but only misplaced in some other puzzle, so that once this is recognised it is possible to solve both puzzles at once. The following, I believe, may comprise one such case. In his erudite (...) History of Freethought (London 1936), p. 757, J. M. Robertson presents us with the first puzzle:...seven years before the issue of Hume's Essay on Miracles, we find the thesis of that essay tersely affirmed in a note, to Book II of an anonymous translation (ascribed to T. Francklin) of Cicero's De Natura Deorum. The passage is worth comparing with Hume: "Hence we see what little credit ought to be paid to facts said to be done out of the ordinary course of nature. These miracles [cutting the whetstone, etc., related by Cicero, De Div i, c. xvii] are well attested. They were recorded in the annals of a great people, believed by many learned and otherwise sagacious persons, and received as religious truths by the populace; but the testimonies of ancient records, the credulity of some learned men, and the implicit faith of the vulgar, can never prove that to have been, which is impossible in the nature of things ever to be." M. Tullius Cicero Of the Nature of the Gods... with Notes, London, 1741, p. 85. The ascription to Thomas Francklin seems to have been drawn primarily from the "new edition" (London: T. Davies, 1775), on the title-page of which the translation and notes are said to be "By the Rev. Dr. Francklin". Also relevant to 151!. this attribution are these two facts: (1) that Thomas Francklin' s father, Richard Francklin, originally printed the book in 1741, and (2) that Thomas later translated other classical authors into English, notably Sophocles in 1759. But it is surely puzzling that Thomas, who in 1741 was barely twenty years old, and soon to be ordained and later made a Doctor of Divinity, should anticipate Hume's famous criticism of miracles. Consider now the second puzzle. It concerns Anthony Collins, the "Goliath of Freethinking" - as T. H. Huxley called him. In his Scheme of Literal Prophecy Considered (London, 1727) Collins promised a discourse on miracles "which is almost transcribed" (p. 439); and, indeed, it was about time, since by that date Collins had attacked nearly every other part of the Christian edifice. But no such work ever appeared in Collins' s lifetime. Nor is this the only book which Collins came close to publishing. From private letters of Collins' s in the British Library (MS 4282) we learn that he planned to publish an annotated translation of two of Cicero's writings. Thus in a letter of 26 September 1721 he speaks of "publishing my translation of Cicero's books of ye Nature of the Gods and of Divination" For "Nothing [he writes in the same letter] can more tend to promote good sense in the world than some of his [Cicero's] Philosophical Works; which are applicable to all sorts of folly and superstition by those who have Eyes to see and Ears to hear." The reader will now probably guess my drift: Collins was responsible for the 1741 edition of Cicero and its acute comment on miracles. But why, it will be asked, has this connection not been made before? The obvious answer is that since Collins died in 1729 twelve years separated his name from the 1741 edition. The evidence which firmly connects him with it is to be found (a) on the last page (279) of his Historical and Critical Essay on the Thirty Nine Articles (London 1724): "Speedily will be published, Cicero's Treatises of the 152. Nature of the Gods and of Divination. Translated into english [sic], with annotations. In two volumes." and (b) on the title-page. For the Historical and Critical Essay was printed by none other than R. Francklin, the very one who printed the 1741 edition of Cicero. The received account of whistleblowing, developed over the last quarter century, is identified with the work of Norman Bowie and Richard DeGeorge. Michael Davis has detailed three anomalies for the received view: the paradoxes of burden, missing harm and failure. In addition, he has proposed an alternative account of whistleblowing, viz., the Complicity Theory. This paper examines the Complicity Theory. The supposed anomalies rest on misunderstandings of the received view or misreadings of model cases of whistleblowing, for example, the (...) Challenger disaster and the Ford Pinto. Nevertheless, the Complicity Theory is important for as in science the contrast with alternative competing accounts often helps us better understand the received view. Several aspects of the received view are reviewed and strengthened through comparison with Complicity Theory, including why whistleblowing needs moral justification. Complicity Theory is also critiqued. The fundamental failure of Complicity Theory is its failure to explain why government and the public encourage and protect whistleblowers despite the possibility of considerable harm to the relevant company in reputation, lost jobs, and lost shareholder value. Ethiopian agriculture is changing as new actors, relationships, and policies influence the ways in which small-scale, resource-poor farmers access and use information and knowledge in their agricultural production decisions. Although these changes suggest new opportunities for smallholders, too little is known about how changes will ultimately improve the wellbeing of smallholders in Ethiopia. Thus, we examine whether these changes are improving the ability of smallholders to innovate and thus improve their own welfare. In doing so, we analyze interactions between smallholders (...) and other actors to provide new perspectives on the role played by smallholder innovation networks in the agricultural sector by drawing on data from community case studies conducted in 10 localities. Findings suggest that public extension and administration exert a strong influence over smallholder networks, potentially crowding out market-based and civil society actors, and thus limiting beneficial innovation processes. From a policy perspective, the findings suggest the need to further explore policies and programs that create more space for market and civil society to participate in smallholder innovation networks and improve welfare. From a conceptual and methodological perspective, our findings suggest the need to incorporate rigorous applications of social network analysis into the application of innovation systems theory. This paper examines a range of issues concerned with the process of choosing schools in the private and state sectors at the primary/pre‐preparatory stage and at the time of transfer to secondary/senior school. The findings indicate that choices about schools are made at different times and in different ways by parents who use the state and private sectors. One of the key findings is that the process of choosing a school begins earlier in the private than in the state sector; (...) another is that quality of education is cited more frequently as one of the ‘top three’ essential factors by parents of children in the private sector. At both the primary and transfer to secondary stages, very high percentages of parents consider it essential that their child should be happy. A discussion of the different notions that private school and the state school parents may have of ‘happiness’ is offered. (shrink)

Much has been written about recidivist punishments, particularly within the area of criminology. However there is a notorious lack of penal philosophical reflection on this issue. This book attempts to fill that gap by presenting the philosopher’s view on this matter as a way of furthering the debate on recidivist punishments.

Mark Richard argues for truth-relativism about claims made using gradable adjectives. He argues that truth-relativism is the best explanation of two kinds of linguistic data, which I call: true cross-contextual reports and infelicitous denials of conflict. Richard claims that such data are generated by an example that he discusses at length. However, the consensus is that these linguistic data are illusory because they vanish when elaborations are added to examples of the same kind as Richard’s original. In (...) this paper I defend the reality of Richard’s data. I show that, in trying to make their point, Richard’s critics have focused upon examples that are similar in some respects to Richard’s original but which lack a crucial feature of that original. When we ensure that this feature is in place, elaborations which make the data vanish are not possible. Richard’s critics therefore fail to show that the data generated by Richard’s original example are illusory. (shrink)

To become fully aware of the original and radical character of his transcendental phenomenology Edmund Husserl must be located within the historical tradition of Western philosophy. Although he was not a historian of philosophy, Husserl's his torical reflections convinced him that phenomenology is the necessary culmination of a centuries-old endeavor and the solution to the contemporary crisis in European science and European humanity itself.l This teleological viewpoint re quires the commentator to consider the tradition of Western philosophy from Husserl's own (...) perspective. Husserl maintained that the Cartesian tum to the "Cogito" represents the crucial breakthrough in the historical advance of Western thought toward philosophy as rigorous science. Hence 2 he concentrated almost exclusively on the modem era. Much has been written of Husserl's relationship to Descartes, Kant, and the neo-Kantians. His connections with Locke, Berkeley, and Hume have not been examined as closely despite his fre quent allusions to these British empiricists. Among these thinkers David Hume gained from Husserl the more extensive considera tion. Commentators have pointed out correctly that Husserl always criticized unsparingly Hume's sheer empiricistic approach to the problem of cognition. Such an approach, in Husserl's view, can only result in the "naturalization of consciousness" from which stem that "psychologism" and "sensualism" which lead Hume inevitably into the contradictory impasse of solipsism 3 and skepticism. This is the third volume to appear in an edition that will be the first complete, critical, and annotated English translation of all of Nietzsche's work. Volume 2: _Unfashionable Observations_, translated by Richard T. Gray, was published in 1995; Volume 3: _Human, All Too Human _, translated by Gary Handwerk, was published in 1997. The edition is a new English translation, by various hands, of the celebrated Colli-Montinari edition, which has been acclaimed as one of the most important works (...) of scholarship in the humanities in the last half century. The present volume provides for the first time English translations of all of Nietzsche's unpublished notebooks from the summer of 1872 to the end of 1874. The major works published in this period were the first three _Unfashionable Observations_: "David Strauss the Confessor and the Writer," "On the Utility and Liability of History for Life," and "Schopenhauer as Educator." Translations of the preliminary notes for these pieces are coordinated with the translations of the published texts printed in Volume 2: _Unfashionable Observations_. The content of these notebooks goes far beyond the notes and plans for published and unpublished _Unfashionable Observations_, encompassing numerous sketches related to Nietzsche's major philological project from this period, a book on the pre-Platonic Greek philosophers. The ideas that emerged from Nietzsche's deliberations on these early Greek thinkers are absolutely central to his thought from this period and contribute in significant ways to the development of several of his major themes: the role of the philosopher vis-à-vis his age and the surrounding culture; the relationships among philosophy, art, and culture; the metaphorical nature of language and its relationship to knowledge; the unmasking of the modern drive for absolute "truth" as a palliative against the horror of existence; and Nietzsche's "unfashionable" attack on modern science and modern culture, especially on the Germany of the Bismarck Reich. These notebooks represent important transitional documents in Nietzsche's intellectual development, marking, among other things, the shift away from philological studies toward unabashed cultural criticism. In the management and business ethics literatures, stakeholder engagement has been demonstrated to lead to more ethical management practices. However, there may be limits on the extent to which stakeholder engagement can, as currently conceptualized, resolve some of the more difficult ethical challenges faced by managers. In this paper we argue that stakeholder engagement, when seen as a way of reducing five types of knowledge problems—risk, ambiguity, complexity, equivocality, and a priori irreducible uncertainty—can aid managers in resolving such ethical challenges. Using a practical illustration of the ethical challenges surrounding the development and application of genetic modification technologies, we demonstrate how stakeholder engagement enables managers to better address these knowledge problems, thereby to manage more ethically. In this way, we suggest that stakeholder engagement has an even more crucial role to play in business ethics research and practice. (shrink)

Bayesian models of legal arguments generally aim to produce a single integrated model, combining each of the legal arguments under consideration. This combined approach implicitly assumes that variables and their relationships can be represented without any contradiction or misalignment, and in a way that makes sense with respect to the competing argument narratives. This paper describes a novel approach to compare and ‘average’ Bayesian models of legal arguments that have been built independently and with no attempt to make them consistent (...) in terms of variables, causal assumptions or parameterization. The approach involves assessing whether competing models of legal arguments are explained or predict facts uncovered before or during the trial process. Those models that are more heavily disconfirmed by the facts are given lower weight, as model plausibility measures, in the Bayesian model comparison and averaging framework adopted. In this way a plurality of arguments is allowed yet a single judgement based on all arguments is possible and rational. (shrink)

In Adelaster (2016), A. G. Conte proposes a distinction between de dicto and de re attributions of truth and falsity, which he illustrates mostly with documents of legal standing, but also with an artificial object (a false tooth). The present aim is to propose an analogous distinction between monadic (one-place) and polyadic uses of “true” and “false”, and to sketch some features of its logical functioning with closer attention to the monadic pole than is usual.
